Terms of Service

These terms cover your use of Arkenso and the products you subscribe to on it. Subscribing means you accept them.

1. Who you are contracting with

Arkenso is operated by [LEGAL ENTITY NAME], registered at [REGISTERED ADDRESS] (“we”, “us”). “You” means the person or organisation that opens an account. If you open an account for an organisation, you confirm you are authorised to accept these terms on its behalf, and “you” then means that organisation.

2. The service

Arkenso is a platform of separately subscribed products. You choose which products you want; the account, billing and login are shared across them. Each product is a hosted web application — there is nothing to install, and we run and maintain it.

We may change, add or remove features. Where a change materially reduces the functionality of a product you are paying for, we will give you at least 30 days’ notice and you may cancel that product without further charge.

3. Trials

Each product offers a 14-day free trial. No payment card is required to start one. Trials give you the full product with real usage limits, not a demonstration. A trial does not convert into a paid subscription unless you choose to subscribe; if you do nothing, access ends when the trial does.

4. Fees and billing

  • Each product is priced separately, and you pay only for the products you subscribe to.
  • Plans include a number of user seats. Adding people beyond that number is charged per extra seat.
  • You may pay monthly or annually. Annual billing is charged at ten months for twelve.
  • Subscriptions renew automatically at the end of each billing period until cancelled.

Payments are processed by Stripe. We do not receive or store your full card details. Your use of the payment process is also subject to Stripe’s terms.

If a payment fails we will retry it and tell you. If it remains unpaid we may suspend access to the affected product. We will not delete your data for non-payment without giving you notice and an opportunity to export it.

5. Price changes

We may change prices. For an existing subscription, a price change takes effect at your next renewal and we will give you at least 30 days’ notice before that renewal. You can cancel before it applies.

6. Cancelling

You can cancel any product yourself from your account at any time, without contacting us. Cancellation takes effect at the end of the billing period you have already paid for, and you keep access until then. See the Refund and Cancellation Policy for what is and is not refundable.

7. Your data

The data you put into Arkenso is yours. We do not sell it, and we do not use the contents of your workspace to train models. We process it to provide the service, as described in the Privacy Policy.

Every product exports to CSV or Markdown, and you can export at any time including while cancelling. After cancellation we retain your data for 30 days so you can reactivate or export, then delete it.

8. Acceptable use

You agree not to:

  • break the law, or use Arkenso to help someone else do so;
  • upload malware, or attempt to breach or test our security without written permission;
  • attempt to access another customer’s data;
  • resell or sublicense a product without our agreement;
  • place load on the service designed to degrade it for others.

We may suspend an account that is actively causing harm. Except where the harm is ongoing or legally urgent, we will tell you first and give you a chance to fix it.

9. Availability

We aim to keep Arkenso available and to give notice of planned maintenance, but we do not offer a contractual uptime guarantee at these prices. [If you intend to offer an SLA on Enterprise plans, state it here or in a separate agreement.]

10. Calculated outputs

Several products produce forecasts, scores, probabilities and price recommendations. These are decision support, not advice, and they can be wrong. Each one shows the inputs and method behind it so you can check it. You remain responsible for the decisions you take, including pricing, employment, tax and compliance decisions.

11. Warranties and liability

The service is provided as described, without implied warranties of fitness for a particular purpose. To the extent permitted by law, our total liability to you in any twelve-month period is limited to the fees you paid us in that period. Neither party is liable for indirect or consequential loss, or for loss of profit, revenue or data, except where the law does not allow that limit.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

12. Ending the agreement

You may stop using Arkenso at any time by cancelling. We may end this agreement with 30 days’ notice, or immediately for a serious or repeated breach of section 8. If we end it other than for your breach, we will refund the unused portion of any period you have paid for.

13. Changes to these terms

We may update these terms. For material changes we will give at least 30 days’ notice by email or in the application. Continuing to use Arkenso after a change takes effect means you accept the updated terms.

14. Governing law

These terms are governed by the laws of [JURISDICTION], and the courts of [JURISDICTION] have exclusive jurisdiction, except that either party may seek injunctive relief wherever necessary.
